Eton Pharmaceuticals has secured exclusive U.S. commercialization rights to LIBERVANT (diazepam) buccal film from Aquestive Therapeutics, targeting the seizure-cluster rescue market, which the companies estimate exceeds $450 million annually in the United States. The product has tentative FDA approval for certain age groups, while a separate application to expand its use to children aged 6 to 11 remains under review.
Exclusive Licensing Agreement Expands Eton’s Neurology Portfolio
The agreement combines Aquestive’s buccal film technology with Eton’s commercial infrastructure, specialist engagement and patient support capabilities. Eton expects to launch LIBERVANT in April 2027, subject to final FDA approval and the outcome of ongoing regulatory proceedings.
The deal gives Eton an entry into neurology and adds a potential growth driver to its rare disease portfolio. Chief Executive Officer Sean Brynjelsen said the company plans to establish a dedicated neurology team while drawing on its existing commercial infrastructure and experience with specialty medicines, including INCRELEX, GALZIN and HEMANGEOL.
Aquestive Chief Executive Officer Daniel Barber said the partnership provides a focused route to U.S. commercialization for a product intended to offer an alternative to existing nasal and rectal seizure rescue treatments.
Buccal Film Offers an Alternative to Existing Rescue Treatments
Seizure clusters are episodes of frequent seizures that differ from a patient’s usual seizure pattern. They require prompt rescue treatment to help manage acute episodes and limit their potential consequences.
LIBERVANT contains diazepam, a benzodiazepine that enhances gamma-aminobutyric acid (GABA)-mediated inhibitory signalling in the central nervous system. The buccal film is placed inside the cheek, where it dissolves without requiring a separate delivery device. It is intended for intermittent rescue use rather than as a substitute for daily maintenance antiseizure therapy.
The formulation could provide another administration option for patients and caregivers who need to carry rescue medication outside the home. However, its potential practical advantages should not be interpreted as evidence of superior clinical efficacy over currently available products.
Patient Research Indicates Preference for Buccal Film
Third-party market research involving 101 patients highlighted concerns about access to rescue medication when away from home. Although 76% of respondents were somewhat or highly concerned about not having their medication within arm’s reach, only 34% reported always carrying it outside the home.
In a separate preference assessment following a video comparison of film and nasal-spray packaging, 71% preferred or strongly preferred the film, compared with 13% for nasal spray, assuming equivalent efficacy.
These findings suggest that portability and administration preferences could influence product adoption. However, the results reflect stated preferences rather than real-world adherence, clinical outcomes or comparative effectiveness.
FDA Status and Potential Launch Timeline
The FDA granted LIBERVANT Orphan Drug Designation in November 2016. The product has received tentative approval for the acute treatment of seizure clusters in patients with epilepsy aged 2 to 5 years and 12 years and older.
Full approval for patients aged 12 years and older is expected to become possible following the scheduled expiration of VALTOCO’s orphan drug exclusivity on January 10, 2027. Meanwhile, a Type 9 New Drug Application seeking to expand LIBERVANT’s indication to children aged 6 to 11 has a Prescription Drug User Fee Act target action date of March 29, 2027.
The company anticipates commercial availability in April 2027, contingent on the required regulatory approvals. LIBERVANT also has issued patent protection extending into 2038, with additional patent applications pending before the U.S. Patent and Trademark Office.
Commercial Opportunity Depends on Regulatory Execution
The estimated U.S. seizure rescue market exceeds $450 million annually, offering Eton a potential opportunity to establish a differentiated product in an existing treatment category. Orphan Drug Designation, patent protection and patient-reported formulation preferences could support its commercial positioning.
However, the timing of approval across age groups, competition from established rescue therapies and the translation of stated preferences into prescribing and carrying behaviour will shape the product’s uptake. The partnership establishes a commercialization pathway, but its commercial value will depend on regulatory execution and adoption after launch.
Clinical Interpretation
LIBERVANT could expand seizure-cluster rescue options by offering a buccal formulation that does not require a separate delivery device. Patient preference data suggest that portability and ease of administration may influence treatment acceptance, particularly when patients are away from home. However, these findings reflect stated preferences rather than demonstrated clinical benefits. Its clinical and commercial relevance will depend on final FDA approval, comparative treatment considerations and real-world adoption.
